Voyago Rental Service Agreement Terms and Conditions

This Rental Service Agreement comprises these Terms and Conditions, outlining the details of the hire arrangement.

Vehicle Description

1. Voyago agrees to let, and the Hirer agrees to take on hire, the motor vehicle described in the attached Term Sheet (Vehicle).

Hire Term

2. The Vehicle is hired for the period specified in the Term Sheet (Hire Period).

3. The Hirer must return the Vehicle by the time and date specified or obtain prior consent for an extension. Additional charges may apply for late returns.

4. The Vehicle is not considered returned until both the Vehicle and its keys are delivered to the agreed location.

Authorized Drivers

5. Only the Hirer and additional authorized drivers listed in the Term Sheet may drive the Vehicle.

6. All drivers must hold a New Zealand or acceptable overseas full, valid driver’s license suitable for the Vehicle.

Hire Charges

7. Charges are calculated on a daily basis (24-hour periods), with rates specified in the Term Sheet. 

8. Additional charges apply for:

• Late returns (after a 30-minute grace period).

• Refueling if the Vehicle is not returned with a full tank.

• Excess mileage, if applicable.

• Cleaning or deodorizing for excessive dirt or odors.
• Key replacement or courier fees if keys are lost.
• Road tolls, parking fines, and traffic infringement fees incurred during the Hire Period are the responsibility of the Hirer.

9. Voyago reserves the right to deduct charges, including but not limited to those listed in Clause 8, from the Hirer’s credit card either during or after the Hire Period. Alternatively, the Hirer may pay such charges directly as agreed with Voyago. The choice of deduction or direct payment is at Voyago’s sole discretion.

Hirer’s Obligations

10. The Hirer agrees to:

• Take reasonable care when using and parking the Vehicle.

• Ensure the Vehicle is locked and secure when unattended.

• Check and maintain appropriate levels of water, oil, and tyre pressure.

• Immediately report any damage, accidents, or mechanical issues to Voyago.

• Not allow smoking, the transport of animals (except guide dogs), or the use of the Vehicle for illegal purposes.

Owner’s Obligations

11. Voyago will supply the Vehicle in a safe and roadworthy condition.

12. Cover routine maintenance, except for damage resulting from the Hirer’s negligence or misuse.

Insurance

13. Voyago provides basic insurance for the Vehicle, covering:

• Collision Damage: For damage from accidents.

• Theft or Loss: For theft or loss, subject to security and reporting requirements.

• Third-Party Liability: For damage or injury to third parties.

14. Excess: The Hirer is liable for the excess as specified in the Term Sheet, regardless of fault.

15. Excess Reduction Buyout (ERB):

• The Hirer may purchase an ERB to reduce or waive the excess liability, as detailed in the Term Sheet.

• If purchased, the Hirer’s excess liability is reduced to $0 or a lower amount, depending on the ERB terms.

16. Insurance does not cover:

• • Driving under the influence of alcohol or drugs.

• • Reckless, off-road, or unauthorized use of the Vehicle.

• • Damage caused by fuel contamination, improper use, or negligence.

• Any claims denied by the insurance provider due to breaches of policy terms. In such cases, the Hirer remains fully liable for the costs of repair, replacement, or associated damages.

17. The Hirer may use their own insurance, subject to approval by Voyago, and assumes full liability for any loss or damage to the Vehicle.

Bond (Security Deposit)

18. The Hirer agrees to provide a bond in the amount specified in the Term Sheet or authorize the retention of their credit/debit card details on file. This bond covers potential damages, unpaid charges (including fines, penalties, toll fees), or other costs incurred during the Hire Period. The bond may be paid by credit card pre-authorization, by retaining card data on file, or, if agreed upon, in cash accompanied by proof of address.

19. The bond will be refunded to the Hirer immediately upon the vehicle’s return, subject to:

• • Inspection of the vehicle confirming no damage.

• • Clearance of any outstanding charges or fees.

• Compliance with all terms and conditions of the agreement.

20. If any claim or cost arising from the Hire Period is discovered after the bond has been refunded, the Hirer remains fully liable for payment. This includes, but is not limited to, fines, penalties, toll fees, damages, or other costs not identified at the time of vehicle return. Voyago reserves the right to recover such amounts through the payment method provided by the Hirer or by issuing an invoice for settlement.

Accidents, Repairs, and Breakdowns

21. In the event of an accident or breakdown, the Hirer must:

• Contact Voyago immediately and follow instructions.

• Avoid unauthorized repairs or modifications, except to prevent further damage.

22. Voyago offers 24/7 AA roadside assistance. Charges may apply for non-mechanical issues caused by the Hirer, such as flat batteries due to lights being left on, ‘lockout/ lost keys, out of fuel or tyre damage from improper use.(call AA on 0800 734 543 in case of any Brakedown).

23. If the Vehicle cannot be recovered or repaired due to a breakdown, Voyago may, at its sole discretion provide a replacement vehicle, subject to availability.

Use of the Vehicle

24. The Vehicle must not be used to:

• Transport passengers for hire or reward unless authorized by Voyago.

• Participate in races, contests, or illegal activities.

• Exceed the passenger or weight limit specified for the Vehicle.

• Drive off-road or on restricted roads (e.g., beaches, unpaved tracks).

• Operate or allow it to be operated in breach of:

• The Land Transport Act 1998, the Transport Act 1962, the Land Transport (Road User) Rule 2004, or any other applicable Acts, regulations, rules, or bylaws relating to road traffic. The Freedom Camping Act 2011.

Return of the Vehicle

25. The Hirer must return the Vehicle to the agreed location in the same condition as received, except for reasonable wear and tear.

26. Additional fees apply for cleaning, fuel refilling, or damages.

Cancellation and Termination

27. Voyago reserves the right to terminate this agreement and repossess the Vehicle if the Hirer breaches any terms or if the Vehicle is misused.

28. Voyago reserves the right to apply cancellation fees for bookings canceled within 48 hours of the Hire Period start. These fees are calculated as: a. 10% of the total booking value; or b. A minimum of $50 (whichever is greater).

29. Cancellations made after the 48-hour window will incur a 100% charge of the total booking value, as the booking will be considered non-refundable.

Privacy and Data Use

30. Voyago collects personal information for the purpose of vehicle hire and customer service. This information may be shared with enforcement authorities, insurers, or collection agencies if necessary.

31. The Hirer agrees that Voyago may collect and retain a copy of the Hirer’s driver’s license for the purpose of verifying eligibility to hire the Vehicle. This information will be securely stored and only used in accordance with privacy laws.

32. Voyago may monitor the Vehicle’s location and usage to ensure security and compliance with this agreement. Any personal data collected will be handled in accordance with privacy laws and Voyago’s privacy policy, and accessed only when necessary for security or operational purposes.

33. By agreeing to this rental agreement, the Hirer authorizes Voyago to retain their payment details for processing payments, pre-authorizing security deposits, and charging for any additional costs incurred. Voyago will store payment information securely and in compliance with applicable data protection laws.

Note to Hirer

34. A copy of this agreement must be kept in the Vehicle at all times and produced upon request by enforcement officers.
